if you are a permanent resident who came to america by way of your husband's petition would divorcing him affect your permanent resident status in any way? the husband is already a us citizen and so are the childrenWould divorcing your husband affect in any way a us permanent resident status?
Yes it does. I am going through the same situation.





I am a citizen and my (soon to be ex) wife is Filipino.





The rules are simple. You MUST be married for 3 years. You can file for divorce before the three years but you can not get divorced before.

If you have been married more than 2 years you should have no problems. My girlfriend sitting here is from the UK married to US man. She said it is a 2 year probation period than after that you get a 10 year green card.
Yes, especially you are married to a citizen. Immigration bureau is very sensitive about people who solely uses marriage to get green card. Once you become a citizen, you can divorce any time you want.
